A.P.Advocates Welfare Fund” – Resolution of the General Body of the  “Bar Council of Andhra Pradesh” held on 21-07-2024, to allow the Advocates in the Age Group between 35 to 60 years to become Members of the “A.P.Advocates Welfare Fund” under  One Time Measure.

The General Body of the Bar Council of Andhra Pradesh, under the Chairmanship of Sri Nallari Dwarakanath Reddy, met on 21-07-2024 and discussed the issue of submission of Renewal/ Fresh Certificate of Practice (COP) applications, to be submitted by the Advocates, in pursuance of the directions of the Bar Council of India.

The Council, after considering the representations received from the Advocates and the Bar Associations and after due deliberations,  has decided to constitute a Committee with the Members of the Bar Council, to look into the issue for examination of the relevant  Rules, BCI Circulars and directions of the Central Verification Committee, constituted by Hon’b1e Supreme Court, to seek clarification from the Bar Council of India, on the subject.

Therefore, the Bar Council has resolved to stay  the directions  till 31-08-2024, issued in the above referred letter. After a direction from the Bar Council in this regard, the Advocates can file Renewal / Fresh COP applications.

The Presidents and Secretaries of all the Bar Associations are hereby requested to communicate  the decision of the Bar Council amongst the  Advocate-Members of the Bar Associations and place the Circular on the Notice Board of the Association for information of the Advocates.

With reference to the subject cited above, I am to inform you that under  Rule – 9 of COP Rules, 2015, the “Certificate of Practice” issued to an advocate OR under “All India Bar Examination Rules”, shall be valid for a period of 5 years, and is liable to be verified every 5 years by filing an application for verification, before the validity period of “Certificate of  Practice” expires.

In view of the request made by Various Insurance Agencies, the Sub-Committee on 20-05-2024 has resolved to extend the time for   3 more days, i.e. till 23-05-2024 at 4:00 p.m.  for submitting the quotations  for “Group Mediclaim and Personal Accident Policies” for the year 2024-2025. It is hereby informed that there will be no further extension of time.

This is to notify that the Bar Council of Andhra intends to call for quotations from the Nationalized Insurance Companies, to provide  “Group Mediclaim and Personal Accident Policies” to the advocates for the year 2024-25. Out of 38000 eligible advocates, about 10000 advocates may come forward to obtain Insurance Policies.

Therefore, the Insurance Companies or Insurance Broking Services, intend to offer their quotation, shall submit the same, to the office of the Bar Council, in sealed cover, addressing to the Secretary, Bar Council of Andhra Pradesh, High Court Buildings, Amaravati, on or before 20-05-2024.

The quotation shall be submitted for the Sum Insured of Rs.2,00,000/- and Rs. 3,00,000/- for coverage of 1+3 i.e. Self, Spouse and two dependent Children with the annexed features, with and without maternity benefits.

High Court Circular on 19-03-2024 on Clarification regarding independent conduct of cases by the advocate-candidates and issuance of experience certificate to the advocate-candidates of Direct Requitement to the Uttar Pradesh Higher Judicial Services.

The Bar Council of the State of Andhra Pradesh has published the  “List of Non-Practising Advocates” through Notification dated 15-12-2022 under Rule – 20  of the “Certificate & Place of Practice Rules, 2015.

After publication, the Office has received applications for Resumption Practice under the said Rules and the Administrative Committee has allowed 49 Advocates for Resumption of Practice vide Notification dated 29-01-2024.

In continuation of the above, the Administrative Committee has further allowed 71 advocates for Resumption of Pratice and therefore their names are notified  under Rule 28.4 of the “Certificate and Place of Practice (Verification) Rules, 2015” by removing their names from the list of  “Non-Practicing Advocates”.

The Bar Council of the State of Andhra Pradesh has published the “List of Non-Practising Advocates” through Notification dated 15-12-2022 under Rule – 20  of the “Certificate & Place of Practice Rules, 2015.

With reference to the subject cited above, I am to inform that the advocates qualified All India Bar Examination and completed 5 years, after passing the Examination, shall submit COP applications, under Rule – 9 of the “Certificate & Place of Practice Rules, 2015”.

          Therefore, the Advocates of the following two categories shall submit the applications, though they have filed Declarations.

1. Advocates, Enrolled from 01-01-2010 to 31-12-2018 & passed All India Bar Examination I to XIII.
2. Advocates, Enrolled from 01-01-2010 to 31-12-2018 and passed Law Course, prior to 2009-10 Academic years.

          The duly filled up applications can be sent to the Office on or before 06-01-2024 along with enclosures, mentioned in the application, by paying fee of Rs. 500/-, through SBI Challan.

Further, it was brought to the notice of the Bar Council, that the Office bearers of some of the Bar Associations are certifying, even the non-practising Advocates at Column III of Form ‘A’ of the Application. Therefore, it is hereby informed that the Bar Associations shall certify, only the practising Advocates, otherwise the Bar Council will be at liberty to take appropriate action, against the concerned Office bearers, under Rule – 8 of the COP Rules.

This is to inform you that the Advocates, below 5 years of practice, after passing All India Bar Examination, shall submit  “Declaration Forms”, as per the direction of the Bar Council of India, for the purpose of revision of the Rolls of the Council and to identify  Non-Practising Advocates.

Therefore, the below two categories of Advocates have to file the Declaration Forms :

1. Advocates, enrolled from 01-01-2010 to 31-03-2023, passed All India Bar Examination XIV to XVII.
2. Advocates enrolled from 01-01-2019 and passed Law Course, prior to 2010.

The Advocates can verify the status from the Website  of Bar Council and download the Declaration Form and can send the Form, after obtaining the signatures from the President / Secretary of the  Bar Association, with Seal of the Association and i) Proof of passing of AIBE Examination ii) Copy of Provisional Enrolment Certificate iii) Additional Photograph in advocates Robes.

The applications shall reach the Office on or before 06-01-2024.     The Advocates, who have already filed Declaration Forms, need not file the same. After scrutiny, the details will be placed in the website of Bar Council for information.
